The Proof of Expertise Act for Real Estate Agents and Administrators comes.
The decision of the Federal Cabinet on the draft law on the proof of expertise for real estate agents and administrators has finally been taken. This means that the law will come into force as early as January 1, 2017, if all the prerequisites are met.
What does this law regulate?
The draft law establishing a vocational registration scheme provides in principle for an amendment to Section 34c of the Industrial Code. The new law is intended to extend the existing licensing requirements, such as the reliability of commercial law and the orderly financial situation. The conclusion of professional inder insurance and a certificate of competence as new conditions for the exercise of the profession should therefore be absolutely necessary as a prerequisite.
These requirements are not only intended to protect consumers, because in the future they will only have to deal with brokers who understand their trade professionally. The increased quality of the service also significantly increases the reputation of the professional group of real estate agents.
What about the real estate agents who have been working for years?
Under the current draft law, administrators and brokers who have worked continuously for more than six years do not have to pass an expert examination. Many years of experience and professional practice of these brokers" is recognized by the legislator as a qualification. They do not have to pass an examination, but they must prove their competence to their supervisory authority by appropriate documentation.
And what about the "newcomers"?
Those who have not been active for six years must prove their skills by means of an examination with the relevant Chamber of Commerce and Industry in addition to the requirements of Section 34 c GewO, if their existing qualification is insufficient.
The qualifications that will suffice have yet to be regulated in the legislative regulation.
